Our office has filed lawsuits for banquet servers and other food and beverage service workers, including hotel room service workers, who claim they were not paid proper their proper share of mandatory customer service or gratuity charges. Those charges are often imposed at about 20% of the cost of the banquet service or room service food and beverage bill given to the customer. The customer understands that they are paying those charges instead of leaving a voluntary tip and as a result often leave no voluntary tip. Our office believes many employers who collect service or gratuity charges fail to properly distribute those charges to their employees.
